No law empowers the Supreme Court to award costs against lawyers — Falana

By Femi Falana, SAN

An application was filed in 2020. It was taken in 2023 due to no fault of the counsel. The apex court gave the impression that the counsel woke up to file the application very, very recently.

Even under the military junta, we challenged a decree that sought to penalise lawyers for challenging anything done or purported to be done under the Legal Practitioners Amendment Decree No 21 of 1994. See In Frederick Rotimi Alade Williams v. Akintunde (1995) 3 NWLR (Pt. 381) 101 @ 115.

The point that I am struggling to make is that no law empowers the Supreme Court to award costs against lawyers.

The only law that empowers a judge in Nigeria to award costs against a lawyer for delaying a case is the Administration of Criminal Justice Act. See Section 396(6) thereof. In FRN v Omoyele Sowore, the Federal High Court (per Ojukwu J.) awarded cost of N200,000 against the counsel to the state security service for delaying the treason trial of the Defendant. The counsel, a SAN, paid the cost before the case was allowed to proceed…

It is at the discretion of the court to award cost. The ultimate requirement is that such discretion must be exercised judicially and judiciously. See NNPC v. Clifco Nigeria Ltd [2011] LPELR-2022(SC).

In the above-mentioned case, the Supreme Court court was addressing the award of cost against litigants, which is allowed by the law.

But when cost is awarded against a lawyer, it can not be said that the apex court exercised its discretion judicially and judiciously as it was not anchored on any known law in Nigeria.

You may, therefore, wish to advise the Chief Justice of Nigeria to amend the Rules of the Court to empower the Justices to award costs against lawyers.

Rethinking and Rebuilding Our Society: The truth we must tell ourselves

By Oyedeji Olufemi

In my many years of community engagement on various issues affecting our society and the efforts to promote behavior change towards reversing these negative concerns. One message kept resonating from the community; they often ask what has the government done for us?

Questions like:

Is it not the corrupt politicians that destroyed our society?

Making our girls vulnerable to prostitution.

Forcing our boys into different kinds of scams (like yahoo yahoo) as means of survival.

They blame the political leaders for all the rot in our society.

To address these questions, I simply educate them in a very simple form.

I said to them, those who destroyed our society are not the politicians or the political leaders as we often referred to them but those who raised them.

The corrupt politician was raised by a family, the lecturer that demand sex for mark was raised by a family, the man who battered his wife was raised by a family, the father that abandoned his children to suffer was raised by a family, the doctor who divert govt property to his private hospital was raised by a family, the judge that compromised the truth was raised by a family, the list is endless.

The society must take responsibility for the rot and moral decadence we see in our society today.

Like politicians, like lecturers, like judges, like doctors. Lets stop trading blames and take responsibility to fix the mess we see in our society today.

We must rethink and rebuild our society. We all have a great role to play and make Nigeria great again.

Finally Rhoda Jatau freed from Bauchi Prison

Rhoda Jatau a Bauchi State health care worker who condemned the alleged killing of Samuel Deborah in Sokoto State, has regained her freedom after 18 tortuous months in prison.

A reliable source who spoke on condition of anonymity told The PUNCH that Jatau was released on bail on Friday following interventions by the Christian Association of Nigeria, the Nigeria Inter-Religious Council and the Christian Solidarity Worldwide Nigeria.

The PUNCH reports that  Jatau, a mother of five, had been detained since May 2022 on the grounds of blasphemy, for sharing a video condemning the lynching of a student, Deborah.

Deborah, a 200-level student of Shehu Shagari College of Education, Sokoto, was brutally murdered after advising against sending religious materials on a WhatsApp page.

The source, however, did not reveal bail conditions or which court had granted Jatau bail, but noted that the Inter-Religious Council had played “a key role” in securing her bail and release.

“Following the outcry from the Christian community in Nigeria over the continued detention of Rhoda Jatau in Bauchi Prison, the Christian Association of Nigeria, the Nigeria Inter-Religious Council, and Christian Solidarity Worldwide Nigeria have swiftly intervened in the matter.

“We are pleased to report that Mrs Rhoda has been granted bail and subsequently released from detention today. We have high hopes that the case will end in praise. Let’s continue to uphold her in our prayers. The leadership of NIREC played a key role. Praise be to our God”, he told our correspondent.

Rape of minor: Enraged Dr Olufemi Olaleye challenges life sentence at Appeal Court

Apparently the last had not been heard about the case of Dr. Olufemi Olaleye, who was recently or raping his wife’s niece

Enraged by his sentence, Olaleye who is the Medical Director of Optimal Cancer Care Foundation, has asked the Court of Appeal to set aside his conviction by the Special Offences and Domestic Violence Court in Lagos.

The doctor was sentenced to life imprisonment on two counts charge of defilement of a child and sexual assault by penetration.

During trial, Femi Olaleye’s wife told the court how gave her sleeping pills in the night to sleep with her 16-year-old niece.

In a notice of appeal filed by his lawyer, Dr Kemi Pinheiro, SAN, Olaleye stated that the Ikeja Sexual Offences and Domestic Violence Court was wrong to have relied on the evidence presented by the prosecution against him.

The News Agency of Nigeria (NAN) reports that he has approached the appeal court through his lawyer, giving reasons why his appeal should be allowed.

The medical practitioner is arguing that “the lower court erred in law when, in the absence of any direct evidence, it held that the alleged victim of the crime was a child of 16 at the time of the offence.”

He said that the prosecution did not tender any documentary evidence in support of its case that the alleged victim of the crime was 16 years old.

In a bit to prove this fact, Pinheiro argued that the prosecution had the onerous duty of presenting the birth certificate of the complainant which would have served as conclusive proof of her age.

But throughout the trial, he said neither the prosecution nor the complainant put forward any documentary proof of the alleged survivor’s age, other than the oral evidence of the witnesses.

The awyer also argued that contrary to the submission that the alleged victim was consistent in her evidence that Olaleye raped her, her evidence was riddled with inconsistencies.

Pinheiro said the alleged survivor never accused the appellant of rape before the police who interviewed her when the alleged events were still very fresh in her mind.

He claimed that it was only four months after the alleged incident occurred that she turned around and alleged that the appellant raped her.

According to him, the court ought to have been suspicious of the time frame between her statements to the police and the Gender Department of the police.

He further argued that the lower court ought not to have relied on the evidence of PW5, Dr Akinbunmi Oyebimpe of MIRABEL, in convicting and sentencing the appellant.

According to him, the examination carried out on the survivor by PW5 was done months after the alleged offence was committed contrary to Oyebimpe’s finding.

Zamfara man to be hanged for killing friend over N100

The Zamfara State High Court sitting in Gusau, the state capital, has sentenced one Anas Dahiru to death by hanging for killing his friend, Shamsu Ibrahim, with a knife over a N100 dispute in the state.

Delivering judgement in the case of culpable homicide, the presiding judge, Justice Mukhtar Yusha’u, on Wednesday, December 6, 2023, convicted Dahiru and sentenced him to death by hanging for killing his friend as enshrined under section 221of the penal code.

Dahiru was said to have stabbed his friend following a dispute over N100 in 2017.

In a related development, the presiding judge also sentenced one Sadiqu Abubakar to life imprisonment for attempted armed robbery in Runji village, Bungudu Local Government Area of Zamfara State.

Abubakar was convicted for attacking one businessman in Runji.

Runji reportedly defended himself, arrested Abubakar the armed robber and handed him over to the police.

Addressing newsmen after the judgement, counsel to the plaintiff, Mansur Lawal, the Assistant Director, Public Prosecution at the Zamfara State Ministry of Justice, said the armed robbery case started in 2021.

On his part, the counsel for the two convicts, Muhammad Ahmad Jamo who is also the Coordinator of Legal Aid Council, Zamfara State, said the judgement will serve as a deterrent to others but that he will explore the possibility of appealing the case.

Nigerian politicians are destroying our young girls – Sam Amadi

Terrible things happen in Nigeria. We have lost the present and we want to lose the future.

I just left Transcorp Hotel Abuja after my news analysis at Arise News TV. As I stepped to the lobby of the hotel, I saw a bevy of pretty young girls in their early 20s crowded in a corner. There were all skimpily dressed as if there were commercial sex workers. The time was 10.30pm.

One of them rushed to greet me. “Good evening sir”. She was one of my students. I recognized her clearly because she had a slight disability and I paid attention to make sure she followed the coursework. I was shocked. I recognized three of those hotly dressed pretty young girls as fresh graduates of my department.

What are they all coming to do at this kind of Hotel at this hour and dressed in this manner? Of course, I think I know what it is. A Nigerian politician or man of means have arranged them for his pleasure and those of his friends and acquaintances. Everyday, our girls are disoriented by these politicians who have neither shame nor conscience because they have access to power and money.

We pride ourselves that we have a large youth population and that is a huge asset. But the truth is that we have a large hardware. The software is highly corrupted. Why do we intend to organize these adolescents into the life of immorality?

This reminds me of the experience I had as a special adviser to senate president. Once we went to open a new government house built by a Governor in one of the southeast states. The Governor arranged a special reception for us. When we got to the venue of the so-called reception, I was shocked. Tens of very young girls sourced from the nearby university – between 17-22 years- were already dancing with top government officials.

I screamed and accosted the majority leader of the State House of Assembly. He boldly answered “Man Sammy, these adolescents are our counterparts”. Wow. What? I requested to be taken back to the hotel. That was the end of the reception for me. I couldn’t believe that someone will arrange first year students for an entourage that has the Senate President and the Chairman of the Senate Committee on Education. We are finished.

These politicians have done more harm than you can imagine. They have destroyed the economy. They have destroyed infrastructure. They have also destroyed the morality and the viability of our human capital. How can such young girls who are debased that early rise up to be moral champions of tomorrow? How? Pretty difficult.’

How Nigerian military missed terrorists’ hideouts and bombed innocent villagers

How did the Nigerian military miss all the criminal and terrorists hideouts including those that brazenly collect taxes from citizens across states in northern Nigeria to bomb hapless Nigerians in their homes? The villagers even allege that the bombing occurred twice.

In September, the Defence Headquarters (DHQ) said it has launched an investigation into a viral video clip of some soldiers chatting with bandits in Katsina State. The Director of Defence Information, Tukur Gusau, said the investigation intended to determine the video’s veracity.

Gusau in a statement said the military’s high command knew certain bandits’ intention to turn around and surrender their guns to the authorities. The statement disclosed that the Chief of Defence Staff (CDS), Christopher Musa, assures Nigerians that the military would engage through every lawful means to ensure peace returns to Nigeria.

“The DHQ assures Nigerians that its non-kinetic measures aimed at restoration of peace are yielding results, with several bandits and other criminal elements surrendering to authority. Governments at all levels are encouraged to allow bandits genuinely willing to surrender to do so while the window is still open.,” the statement read.

Reports emerged that on Sunday, September 17, the militants were seen holding peace talks with locals in the Faskari Local Government Area of Katsina state. The video generated a lot of outrage on social media, with many wondering why soldiers should chat with bandits that have held the region down for years.

Meanwhile, death toll continues to rise as survivors of the accidental bombing of Tudun Biri in the Igabi Local Government Area of Kaduna State on Tuesday said they were bombed twice by the Nigerian Army.

It was also gathered that the death toll from the incident had increased to 120 as officials of Amnesty International who visited the affected communities confirmed the increase in the death toll.

Nigeria Army said the air strike intended to flush out terrorists had on Sunday night accidentally hit civilians during a religious celebration at Tudun Biri.

While the Army claimed responsibility for the incident, the National Emergency Management Agency had on Monday night put the casualty figure at 85, adding that 66 victims sustained injuries.

But the accidental bombing on Tuesday attracted more condemnations from the pan-Northern political and cultural association, the Arewa Consultative Forum, and the Jama’tu Nasril Islam, saying that those found culpable should be punished.

On their part, President Bola Tinubu, and former Vice President Atiku Abubakar mourned the victims of the bombing. But as the nation mourned the dead, survivors of the bombing recounted their experiences.

Forty-five-year-old Saudatu Alamagani, in an interview with The PUNCH, said the community was bombed twice.

Alamagani, who narrowly escaped being killed in the attack, said the incident started like a Nollywood movie around 10pm when a large number of Muslims celebrating Maulud, the birthday of Muhammad, were bombed.

She said while celebrating the Maulud, “The military started raining bombs on us’’, adding that at first, the worshippers mistook their attackers to be bandits.

She stated that while everybody scampered for safety, dead bodies littered “everywhere.”

She stated that while members of the community went in search of motorcycle operators to convey the critically injured to the nearest medical facilities for treatment, the military bombed the community again.

“They bombed us twice,” she said, adding that “it all started around 10pm when the military started bombing our community. We were celebrating the Maulud, the birthday of Prophet Muhammad.

“While we were looking for motorcycles to convey those that critically needed medical attention to the hospital, the military returned with the bombardment. Many villagers including women, men, children, and even pregnant women were killed during the attack.

“Four members of my family were killed in the attack. Some of the bodies of the dead littered the ground.”

Saudatu appealed to the government to assist members of the community, especially victims’ families to cushion the effect of the bomb attack.

Another survivor, 60-year-old Sulaiman Umar, told our correspondents that the village was bombed twice.

He stated, “I was eating that night when we were bombed. Many people died. We could hardly identify our children; some with their intestines out. They bombed us twice. After the first round of bombs, they came back to bomb us again.

“I ran into a deep forest where I slept till daybreak. We covered the dead with leaves. We separated the males from the females and covered them with leaves.”

120 dead

Giving an update on the tragic incident, The Country Director of Amnesty International, Isah Sanusi, said officials of the organisation were on the ground at the affected communities and counted over 120 persons who died in the bombing.

He said, “I can confirm to you that the current number of casualties in the affected areas is more than 120 persons.”

He explained that there were at least 77 bodies buried in each of the mass graves, insisting that the casualty figure was higher than what NEMA stated.

“According to our contact who was at the scene of the mass burial, there were at least 77 dead bodies in each of the mass graves. There also 17 other persons who are from adjoining villages who lost their lives in the ugly incident,” he stated.

But the NEMA Chief Information Officer, Kaduna State, Halima Suleman, told one of our correspondents that the casualty figure of 85 persons released on Monday by the agency had not been updated when contacted on Tuesday.

She, however, stated that NEMA was intervening in the affected communities, as it took some of the injured persons to hospitals and was providing relief items to others.

“We are, of course, intervening in the communities, because our officials are on the ground there today. They took some persons to hospitals, provided relief items and gave moral support,” she stated.

But the pan-Northern socio-political organisation, ACF, and the Sultan Sa’ad Abubakar lll led Jama’atu Nasril Islam, called for a thorough investigation into the circumstances surrounding the military bombing.

Reacting separately to the incident, the ACF described it as “horrific”, noting that the northern organisation was highly disturbed that such an operation could be contemplated and executed in the densely populated area, “suggesting an inexcusable, scandalous and plausibly incompetent failure of intelligence.”

In a statement by the National Publicity Secretary, Prof. Tukur Muhammed-Baba, on Tuesday, the forum commiserated with the state government and families of victims, praying that “God grant the dead peace.”

The forum noted that efforts must be put in place to avert such “avoidable” loss of lives and property in the future, adding that communities in the Northern states had had enough problems with banditry and should not in any way be further inflicted with more pains.

Consequently, the ACF demanded an apology from the Nigerian Army as well as a full, thorough, honest, and open investigation of the incident, to establish what exactly happened.

According to the ACF, any and all those found guilty of professional or operational incompetence must be severely disciplined, and transparently so.

It also noted that the investigation must be undertaken with the full participation of the people of the affected community (who must not be intimidated into keeping quiet about the gory details of their losses).

“For emphasis, the Kaduna State Government has a duty to act to protect the interest of the victims and not the Nigerian Army personnel that perpetrated the incident.

“Full compensation must be paid for the dead in accordance with current Islamic diya value for individual lives.

“The injured must not only be fully treated free of charge but must also be rehabilitated on full recovery, as well as fully compensated for losses of livelihoods and incomes while on the road to full recovery,” the statement added.

On its part, the JNI in a statement by its Secretary-General, Prof. Khalid Abubakar-Aliyu, reiterated the organisation’s commitment to seeking justice for the victims’ families.

The statement partly read, “The Jama’atu Nasril Islam, representing the collective voice of the Ummah, stands in profound consternation and grief over the tragic incident that unfolded at Tudun-Biri village in Igabi Local Government Area of Kaduna State, during a Maulud celebration, as was reported.

“It is thus with heavy hearts that we express our deepest condolences and sympathies to the families, as well as the loved ones of the deceased victims, and we fervently pray for the swift recovery and healing of those injured.

“JNI therefore vehemently condemns this tragic incident in its entirety and calls for a thorough, impartial, and transparent investigation into the circumstances surrounding the devastating and most unfortunate event. We urge authorities to ensure that those responsible are held accountable in accordance with the subsisting laws.”

DHQ panel

Meanwhile, the military high command at the Defense Headquarters, on Tuesday, said it would be investigating the accidental bombing and would establish a panel for this.

Responding to an inquiry from one of our correspondents, the Director of Defence Media Operations, Maj. Gen. Edward Buba said the military would probe the incident.

He said a panel would be instituted to look into the matter, adding that the details would be communicated.

Buba said, “Yes, the military will probe the incident. When the panel is set up, the details will be communicated accordingly, please.”

Also speaking on the issue, the Director of the Army Public Relations, Brig. Gen. Onyema Nwachukwu stated that with the on-the-spot assessment done by the Chief of Army Staff, he would be able to assemble the right persons to make up the panel.

He said, “From what the COAS has done now, which was to visit the scene of the incident, he would be able to gain insight into the expertise that would be required to carry out the inquiry. This will help in guiding us on the kind of persons that will be in that panel. I can’t speak on how long the investigation will take.”

Timeline of accidental bombing by Nigerian military

Over the years, Nigeria has recorded several accidental strikes by the Nigerian Air Force, killing innocent citizens across the country.

The PUNCH investigations revealed that over 425 persons including children and women had been killed by military accidental bombings between September 2017 and 2023.

A report titled “Air Force Mishaps” by a research organisation that compiles and analyses data about happenings in the country (SBM Intelligence) in February 2023, revealed that over 300 civilians have been killed in accidental airstrikes by the NAF since 2017.

SBM said the airstrikes happened while the NAF was in pursuit of terrorists.

The report lamented that mishaps had increased in the last two years, adding that no compensation had been paid to victims’ families.

According to SBM Intelligence, the mistakes have increased in the last two years with little acknowledgment from the NAF.

It added that Niger, Yobe, Zamfara, Borno, Nasarawa, Kaduna, and Katsina are the worst-hit states in the country.

In this report, PUNCH Online highlights cases of NAF accidental strikes.

1. Kaduna village bombing mishap

Recent of all is the Kaduna village bombing mishap where 85 villagers in Tudun Biri of the Igabi Local Government Area of Kaduna State are feared dead after a bomb was allegedly dropped by a military jet on Sunday.

Residents of the affected communities said they were celebrating Maulud, an Islamic event when the bombs were dropped by the military.

This development has, however, triggered both local and international condemnation.

Following the incident a mass burial was conducted for the victims while the Army claimed responsibility for dropping the bomb on the village.

The Chief of Army Staff, Lt. Gen. Taoreed Lagbaja, has, however, apologised to the relatives of victims of the accidental bombing.

Lagbaja also ordered an investigation into the incident, noting the probe would allow the service to avert such situations in the future.

2. Nasarawa-Benue, Niger border accidental airstrike

In January 2023, The PUNCH reports that 37 people including 27 pastoralists were killed after the bomb exploded at the border linking Benue and Nasarawa states at the Doma local government area of Nasarawa State.

3. Niger State bombing mishap

In April 2022, a NAF fighter jet reportedly killed six children, when it fired a bomb targeted at terrorists in Kurebe village in Shiroro LGA of Niger State.

4. Katsina bomb blast

Also in June 2022, 13 residents were injured while one other died after a NAF fighter jet struck Kunkuna village in the Safana LGA of Katsina on July 7, 2022, among others.

5. Borno 2017 and 2020 bomb attacks

On January 17, 2017, about 52 people were killed while 120 others sustained injuries in an accidental airstrike on an Internally Displaced Persons camp in Rann, Borno State.

Also, on April 13, 2020, 17 people, including children, were killed after a NAF fighter jet bombed Sakotoku village in Damboa LGA of the State.

They sold his head, two wrists and used other parts for ritual

His decomposing body was found buried in a shallow grave at Mile 6, Ajemo area of Abeokuta, the Ogun State capital.

But the most harrowing part of this ugsome tale of the death of Quadri Salami, an 18-year-old 100-level student of Obafemi Awolowo University, Ile lfe, Osun state is the story of how her body parts were sold.

When Quadri Salami went missing last month, his father made a report at Kemta Police Station in Abeokuta.

On account of this, the police swung into action and arrested two alleged ritualists, one Akeem Usman and Ifadowo Niyi, who reportedly confessed to slaughtering the deceased after which his vital body parts were dismembered for ritual purposes.

Niyi was said to have gone with Salami’s head as well as his two wrists and paid N100,000 into Akeem Usman’s account as proceeds from the sale of the body parts.

Unstopping in their wickedness, the suspects were said to have continued selling his other body parts on demand to Internet scammers and ritualists. Eventually, they reportedly buried his heart, two legs, and flesh inside a plastic container for rituals and used the remaining parts for money-making charm.

Akeem and Ifadowo were equally said to have admitted that they have previously used four human heads for money rituals, which is known as “Osole”.

These details were made available to news people by the Ogun state Police Public Relations Officer, SP on Wednesday night.

It was disclosed that on Wednesday, the Commissioner of Police, Abiodun Alamutu, led the Tactical Squad to Mile 6 in the Ajemo area of Abeokuta to a shallow grave where the decomposing body parts of the deceased was exhumed after a tracking clue led to one Akeem who was arrested in possession of the victim’s phone.

Akeem was said to have implicated Ifadowo Niyi, saying that both of them committed the  crime by slaughtering the victim and dismembering his vital parts for ritual purposes.

The statement partly reads  “Ogun State Police Command has unravelled the disappearance of one Quadri Salami “m” 18-year-old a 100 level student of Obafemi Awolowo University, whose father reported at Kemta Police Station on the 14th of November 2023, as a case of a missing person, that since the 8th of November he had not set his eyes on his son and all efforts to locate him proved abortive.

“The Commissioner of Police CP Alamutu Abiodun Mustapha, made a significant breakthrough today the 6th of December 2023 when he personally led a team of Tactical Squad to Mile 6 in Ajemo area of Abeokuta to a shallow grave to exhume the decomposing body parts of the deceased  after a tracking clue beamed at one AKEEM Usman “m” who was arrested in possession with the victims phone.

“He implicated one Ifadowo Niyi “m”  that both of them committed the heinous crime by slaughtering the victim one Quadri and dismembered his vital parts for ritual purposes.

“Ifadowo went away with Quadri’s head, and his two wrist, and paid the sum of one hundred thousand Naira into Akeem Usman’s account as proceeds from the sale of the human body parts.

“The suspects thereafter  continued to sell the victim’s other body parts on demand to Internet fraudsters and buried the heart, two legs, and flesh inside a plastic rubber for rituals and used the remaining parts for “Awure” a crime against humanity.

”Among their confessional statement, the duo admitted that they have used four other human heads for money rituals known as ‘Osole.’

‘The suspects are now in Eleweran at SCID for continuation of discreet investigations and will definitely be prosecuted.

“The CP remain committed to ensuring that justice is served and will continue to investigate further to bring all perpetrators to face the full extent of the law stating that such criminal involvement endangers innocent lives urging parents to collectively work together with the police in Ogun by giving volunteer information to eradicate such nefarious practices.”

Vehicle Inspection Officers can arrest traffic violators — FRSC

The Federal Road Safety Corps (FRSC) says Vehicle Inspection Officers (VIOs) have the legal authority to arrest traffic violators, depending on the state in which they work.

Bisi Kazeem, a Deputy Corps Marshal at FRSC, stated this in Abuja and enjoined motorists to cooperate fully with VIOs to improve road safety.

A unit commander of the FRSC in Abuja had previously stated that VIOs did not have the authority to arrest road traffic violations, such as driving overloaded vehicles or using cell phones while driving.

Dauda Biu, the Corps Marshal, has ordered the immediate withdrawal of the unit commander to the national headquarters for administrative and disciplinary actions.

“The general public is advised to disregard the unit commander’s statement as it had no approval of the FRSC Corps Marshal and does not in any way reflect the corporate or general position of the FRSC.

“In line with sustaining the Corps’ resolve that road safety is a collective responsibility, we acknowledge the role VIOs play in complementing the responsibilities of the FRSC through the enforcement of traffic laws,’’ Kazeem stated.

He urged motorists to always obey all established traffic restrictions and to work with security services deployed to ensure peace and order on the highways, regardless of their corporate purpose.
