Stop Attacking Herdsmen Now – Northern Governors

The Northern Governors Forum (NEF) has called for the stoppage of attacks on innocent Fulani herders in South-East, South-West and South-South states.

The governors said innocent herders should not be vilified while those found wanting should be handed over to the law enforcement agencies.

But governors in the South West, while responding to the call, said there was the need for authorities in Northern Nigeria to call “killer herdsmen” to order.

Daily Trust reports there is tension occasioned by the blame game between herders and residents in many states in the South with attendant deaths and destructions.

While people in the South accused herders of atrocities, some Fulani leaders living in the region said not all of them are criminals.

Herders’ settlements have been torched in Oyo, Ondo, Ogun and Edo States, and there is heightened tension in Abia, a development that prompted some prominent personalities and groups to call on President Muhammadu Buhari to act fast.

An elder statesman, Alhaji Bashir Tofa, had three days ago called on the president to wade into the matter to avert reprisal against people of Southern extraction living in the North.

It was about the same time when the Northern Elders Forum, through its spokesman, Dr Hakeem Baba-Ahmed, made a similar call. On Wednesday, Speaker of the House of Representatives, Femi Gbajabiamila, said it was wrong for one part of the country to lord it over another.

What the Northern governors said

The Chairman of the Northern Governor Forum and governor of Plateau State, Simon Bako Lalong, frowned at recent events in the South, saying they were against the peace move by the Nigerian Governors Forum ((NGF).

He recalled in a statement on Thursday the intervention of the NGF led by its Chairman, Governor Kayode Fayemi, who met with stakeholders in Akure, Ondo State to calm the tension and forge an amicable resolution of the issues was commendable.

“While such intervention was celebrated as a success to be sustained through further engagement between herdsmen and representatives of affected communities, emerging reports of attacks on herders and the gradual introduction of ethnic sentiments in the conflict is disturbing and should immediately be nipped in the bud before it gets out of hand.

“The Northern Governors Forum concedes to the rights of Nigerians to reside wherever they so desire without any molestation or discrimination.

“The criminal elements should not be used to tar any particular ethnic group for any crime as that will portend danger to peaceful coexistence and national unity.

“Rather, such criminal elements should be exposed, isolated and made to face the law of the land without prejudice to their ethnic backgrounds as the motives or criminal actions cannot be said to be the position of their ethnic group.

“In the face of the recent worrisome developments, therefore, the Northern Governors Forum calls for calm and cautions Nigerians particularly those in the affected areas who might have been aggrieved or targeted to exercise restraint,” the statement said.

Lalong said the country was already going through a lot, and that escalating tensions would aggravate the situation to levels that could threaten national security.

‘Avoid unguarded utterances’

Lalong called on leaders across political, ethnic, religious and community lines to avoid utterances and actions that would further fan the embers of distrust, hate, violence and retaliation which can easily escalate the situation and cause chaos.

He equally called on government officials, traditional rulers and opinion moulders to also “rise and speak with one voice by not only condemning crime no matter who is involved but also sending the right signals to those who want to take the laws into their hands and trample on the Nigerian Constitution by attempting to deny others the rights to live and pursue their legitimate business in whatever place they choose to reside.

“Security agencies must also be firm and rise to the occasion by protecting all law-abiding citizens against the threat to their lives and properties irrespective of their ethnic or other affiliations.

“They should also send a clear and unambiguous message to those threatening the peace that they will act decisively to stop them from plunging the nation to anarchy.

“The Northern Governors Forum further assures Nigerians of all ethnic, religious and political persuasions of their constitutional rights to pursue their legitimate businesses wherever they choose within the region and appeal to the people to resist any attempt to lure them into any activity that can threaten the peace and tranquillity of the region and the nation at large,” the statement added.

Killer herdsmen

When contacted to comment on what the governors said, Alhaji Jimoh Dojumo, who is the Special Adviser on Security to the Chairman of the South-West Governors’ Forum, Governor Rotimi Akeredolu of Ondo State said the position of the Northern governors was a welcome development since they were also trying to find a solution to insecurity in the country.

He, however, appealed to the governors to caution the herdsmen to stop destroying other people’s means of livelihood.

According to him, most of the farmers got loans from the banks to finance their farming activities.

He said the herdsmen were free to graze and do business anywhere in the country but it must be under the law.

“The governors should stand bold and tell their brothers the truth.

“They should tell their brothers not to graze to destroy other people’s farms; they should stop kidnapping and raping our women in the bush because it would not work.

“Can anyone go to the bush in Kano and be doing that?

“Here, they kidnap the women in the presence of their husbands.

“Some herders don’t just graze but go to the farm, uproot cassava for their animals to eat…Can you imagine this callousness!”

37 herdsmen, 5,000 cows chased out

One of our correspondents reports that 37  herdsmen and over 5, 000 cows illegally occupying the Ondo State forest reserves have been chased out by the state’s security network agency, Amotekun, for violating the order of the state government of vacating the forest reserves in the state.

This followed the recent order handed down by Governor Akeredolu that all herdsmen illegally occupying the state forest reserves should leave or register with the state government in other to make their operation legitimate.

The Ondo State Commander of Amotekun, Chief Adetunji Adeleye, who disclosed the eviction, said his men were still in the forest to flush out the remaining erring herders.

Adeleye said some of the herdsmen who could not cope with the terms and conditions of the state government had met with the corps and opted to move out of the state peacefully.

He disclosed that the suspects were fished out from Ala, Oda and Ofosu forests.

“Some of them opted to leave the state because they couldn’t meet with our terms and conditions.

“They came through the Chairman of Miyetti Allah in the state. Some opted to go to Osun, Edo and Kogi States.

“So, our men escorted them to the boundaries of those states.

“We have to monitor their movements out of the state so that they would not destroy farms on their way out.

“Other came through the chairman and special adviser to the governor on Hausa matters,” he said.

Nnamdi Kanu’s Facebook account

The social media giant, Facebook, has deleted the account of the Indigenous People of Biafra (IPOB)’s leader, Nnamdi Kanu, after releasing a video where he accused Fulani herdsmen of destroying farmlands.

Kanu published a video showing some men, allegedly members of Eastern Security Network – a militia group in Nigeria’s South-East – engaged in the massive killing of cows in herdsmen’s settlements.

Facebook told the BBC that the company wanted to “give people the chance to speak up” while it also wanted people to “come to the terms that they are safeguarded” whilst on the platform.

In a statement, Facebook said deleting Nnamdi Kanu’s page was in line with the regulations of posting feeds that are defamatory.

A member of the Eastern Security Network group, who wouldn’t want his name mentioned, said the group would appeal against the ban, maintaining that the ban excludes Radio Biafra and its other social media accounts/platforms.

Kanu’s Facebook page had always been the platform for IPOB members worldwide. Nigeria’s government had proscribed the group in 2017.

Kanu, who jumped bail while facing trial over treasonable felony, is consistent in his call for the dismemberment of Nigeria.

El-Rufai’s complaints

Governor Nasir El-Rufai of Kaduna State had on Thursday expressed concern over a video clip circulating on social media which showed the massacre and destruction of properties of Fulani herders in the South, saying it came amidst avoidable rhetoric, frenzied ethnic profiling and unlawful eviction of citizens from their places of domicile.

He called out his colleagues especially those in the South to disavow the ongoing attacks and massacre of Fulani herders in their states.

El-Rufai said criminal actions of insurgents and bandits must not be allowed to tear Nigeria apart.

“We should not be seduced into the dangerous passion of blaming innocents, declaring them guilty of the crimes of others, evicting them, killing and destroying their property.”

The governor who bared his though in an online video clip said: “In difficult times, we must uphold the right of everyone to live, with security and safety.

“The frenzy of ethnic labelling makes solutions difficult and can only guarantee disorder, violence and pain.

“In Kaduna State, we are learning from decades of unfortunate and needless experiences.

“We have faced the tragic manifestations of the indigene-settler divide.

“This has been compounded by criminal activities that often have fatal consequences,” he said.

‘Abominable Ambassadors’: Buhari Shielding Ex-Service Chiefs From Prosecution For Killing #Endsars Protesters — PDP

*Rejects Appointment Of Ex-Service Chiefs

The Peoples Democratic Party (PDP) has rejected the ambassadorial appointment of former Service Chiefs by President Muhammadu Buhari.

In a statement by the Spokesman of the Party, Kola Ologbondiyan, PDP described the appointment as a plot to shield the ex-Service Chiefs from investigation over the “killing of innocent Nigerians and crimes against humanity” under their inglorious watch.

PDP also charged the Senate to eschew all partisan considerations and stand on the side of the people.

“It is indeed sacrilegious and a horrible assault on the sensibility of Nigerians that the APC government is seeking to use ambassadorial appointments as a desperate measure to secure diplomatic immunity for the former commanders and protect them from investigation, arrest and possible prosecution by the International Criminal Court (ICC) for the atrocities committed against innocent Nigerians under their command.

“The PDP asserts that appointing the former service chiefs as ambassadors would confer diplomatic immunity on them and provide them with a route for escape.

“The party further stated that taking such actions at a time the ICC has declared its readiness to commence full investigation on their alleged involvement in the crime against humanity in our country, appears to further validate the allegations against them.

“Moreover, the frenzy by officials of the Buhari Presidency in mounting pressure on the Senate to confirm such abominable ambassadorial nominations has further raised public apprehensions of a desperate attempt to cover the culpability of some other individuals connected to the APC administration”.

According to the statement: “It is shocking that instead of allowing the former service chiefs to answer for the alleged crime against humanity under their command including reported cases of extra-judicial execution, killing of unarmed protesters at Lekki Toll Gate, Lagos, rape, illegal arrest as well as detention and torture of innocent Nigerians, the APC administration is rather plotting their escape.

“The accused service chiefs must not be allowed to use diplomatic immunity to escape investigation and possible prosecution for the killing of unarmed EndSARS protester at Lekki Toll gate and other parts of the country as well as the hundreds of civilians reportedly killed by soldiers in the Zaria massacre.

“This is in addition to series of reported military invasions and the mass shooting in communities in Borno, Yobe, Rivers, Abia, Anambra among other states across the six geo-political zones of our country, where soldiers reportedly razed communities and massacred unarmed civilians under the command of the ex-service chiefs.

“Our party, therefore, calls on Nigerians, across the board, to unite in rejecting these ambassadorial nominations for the accused former commanders and demand that President Buhari should immediately withdraw their nominations from the Senate.

“The least that is expected of President Buhari is to direct the former service chiefs to answer for the alleged crimes,” the statement read.

Woman Prays Court To Compel Ex-Husband To Leave Her House

A middle-aged woman, Habiba Muhammad, on Thursday prayed a Shari’a Court sitting in Rigasa, Kaduna to compel her former husband Umar Adamu to leave her house.

The complainant, who resides in Rigasa area of Kaduna, told the court that Adamu divorced her two years ago but has refused to leave her house saying no one can send him away.

“I inherited the house from my late father. He has refused to move out of my house. He curses and calls me names in the presence of my children,” he said.

In his defence, the defendant said Habiba was still his wife.

”We have 10 children together. Our first child is the owner of the house we are living in. She is lying,” she said.

The judge Malam Salisu Abubakar-Tureta ordered the complainant to bring her house documents on Feb 22. (NAN)

Our Informants Are Officials Of Zamfara, Sokoto Governments — Bandits

Our Informants Are Officials Of Zamfara, Sokoto Governments — Bandits

Bandits operating along Shinkafi/Sokoto Road, Zamfara State have claimed that officials of Zamfara and Sokoto State governments provide them with information with which they strike and evade arrest by military.

The bandits disclosed this during a peace meeting with popular Kaduna-based Islamic cleric, Sheikh Ahmad Gumi, on Tuesday at Makkai forest.

The meeting was in continuation of the peace moves by Gumi.

It was not the first time the Islamic cleric would be meeting with suspected bandits to broker a peace deal.

About three weeks ago, over 500 bandits reportedly agreed to lay down their weapons in Kaduna after he struck a peace deal with them.

A source at the Tuesday meeting told Reporters that the gunmen claimed officials of both state governments provide information on movements of troops and other operational activities discussed during security meetings to them.

The gunmen also accused the Nigerian government of not being sincere in ending instances of banditry and kidnappings.

“They said they have informants in Zamfara and Sokoto State governments giving them information and that the military can’t arrest them,” the source said.

States in the North-West region have in the last 10 years faced devastating attacks from armed bandits, almost 70,000 people have fled the region since April 2019.
According to the International Crisis Group, 11,000 people have died since 2011. Many deaths, particularly in Fulani communities however go unreported.

Several army operations have been launched by the Nigerian government, but most have been largely ineffective.

Some state governments in the region have resorted to signing controversial and secret peace agreements with the gunmen to stop the killings. But despite the accords, communities in such states are still being attacked and residents kidnapped and/or killed. (globalsentinelng)

US, UK Won’t Accept Buratai, Ex-service Chiefs As Ambassadors – Ex-NIIA DG Warns Buhari

A Nigerian professor has warned that former service chiefs nominated as ambassadors will not be accepted by the UK and the US.

Prof. Bola Akinterinwa, the former Director General of the Nigerian Institute of International Affairs stated this on Thursday in an interview with Punch.

He however noted that President Muhammadu Buhari acted within his right to nominate all the service chiefs who were changed last week as non-career ambassadors.

Akinterinwa, however, said there was no assurance that countries like the United States and the United Kingdom who had accused the service chiefs of crimes against humanity would accept the former service chiefs as diplomats.

He spoke on a PUNCH Online interview on Thursday.

Earlier, the Presidency on Thursday said the names of the ex-military commanders were sent to the Senate for confirmation.

The nominees are: Gen Abayomi G. Olonisakin (rtd), Lt Gen Tukur Y. Buratai (rtd), Vice Admiral Ibok-Ete Ibas (rtd), Air Marshal Sadique Abubakar (rtd), and Air Vice Marshal Mohammed S. Usman (rtd).

But Akinterinwa doubted that the ex-service chiefs who were believed not to have performed at home would perform outside the country.

He said, “It is only in Nigeria where a carpenter will want to perform the work of a pilot and where a pilot will want to go into surgical operation to perform cardiothoracic operation.

“When you bring somebody who is perfectly trained to kill to come and engage in diplomatic negotiations at a critical time that globalisation is now a major issue, I think that Mr President is making haste slowly and in this case, he is killing diplomatic initiatives well in advance, this is killing Nigeria softly.”

The former NIIA director general said certain countries like the US and UK which had fingered the immediate past service chiefs of crimes against humanity were not likely to accept the ex-military commanders as ambassadors.

He stated, “The main problem any of the (former) service chiefs may have is that the international community have been speculating that they have violated human rights, that under their watch some people have been killed recklessly without due regard to both international law and international humanitarian law.”

“It depends on the country they will be posted to. If you send a service chief as an ambassador to the United States for instance, what will you expect? US is one of the countries that have accused the service chiefs of having violated human rights. Do you think they will be able to survive in that case in terms of negotiating skill? Not likely. If you send to Britain, the same thing.

“If you send to probably Cote D’Ivoire, Togo, Venezuela, all those places where strategic interest do not constitute the issue, in this case, yes, they may do well but you need someone who is very conversant with a very dishonest manner of operating international politics. International politics is very dishonest, everybody is struggling to undermine the other and you need a sophisticated career ambassador,” the diplomat added.

Continuing, Akinterinwa said, “A country can accept and may not accept (an ambassadorial appointee). The obstacle here even though there is rule of reciprocity if we name one and you refuse to accept, we too have the right to reject your own.

“But it is generally not done. When you present a candidate to a country, rather than writing you a bad letter to say they reject, they may keep quiet. So, long silence, no reply simply means rejection. That is the context under which we call them persona non grata – that is unwanted person.”

The former NIIA director general said Nigeria needs diplomatic careerists to engage in diplomatic negotiations, adding that political or non-career ambassadors have bastardised Nigeria’s diplomacy and foreign policy objectives in recent times.

CAN A SUBPOENAED WITNESS BE INDICTED FOR AN OFFENCE FOR WHICH HE WAS NOT CHARGED?

DASUKI v. FRN & ORS (2020) LPELR-52287(CA)

JUDGMENT DATE: 16TH DECEMBER, 2020

PRACTICE AREA: CRIMINAL LAW AND PROCEDURE

LEAD JUDGMENT: STEPHEN JONAH ADAH, J.C.A.

SUMMARY OF JUDGMENT:

INTRODUCTION

This appeal borders on Criminal Law and Procedure.

FACTS

The appellant, Col. Mohammed Sambo Dasuki appealed against the Judgment (in part) of the Federal High Court, sitting in Abuja, delivered on 25th February, 2020, coram: O.E. Abang, J.

The original parties to the case were the 1st, 2nd and 3rd Respondents. The Charge laid before the Federal High Court against the 2nd and 3rd Respondents was of seven counts.

The appellant was specifically mentioned in counts 1, 2, 3, 4 and 7 of the amended charge as the source and the motivator of the predicate offence in counts 1, 2, 3, 4 and 7 of the charge.

The appellant was not charged as an accused person neither did he under any circumstance made a plea to any of the counts. In fact, the appellant was not arraigned at the Federal High Court. From the record before the Court, the only formal thing the appellant did in the case was to come in as a subpoenaed witness for the 2nd and 3rd Respondents. Despite the fact that the appellant was not charged before the Federal High Court, he was thoroughly indicted in the judgment of the Federal High Court.

Aggrieved with the said decision, the appellant appealed to the Court of Appeal. The crux of the appeal was the conclusion of the trial Court that the appellant was guilty of criminal breach of trust and corruption.

ISSUES FOR DETERMINATION

The Court determined the appeal on these issues couched as follows:

1. Whether in the circumstances of this case, there was a violation of breach of right of hearing of the appellant by the lower Court.

2. Whether the lower Court acted without jurisdiction when in analysis, the essential ingredients of the offences of money laundering under Section 15(2) (a) – (d) of the Money Laundering (Prohibition) Act, 2011 (as amended) as constituted in counts 1, 2, 3, 4 and 7 of the charge, the lower Court made pronouncements on the role of the appellant in the predicate offence of criminal breach of trust and corruption that gave birth to the secondary offence of money laundering upon which the 2nd and 3rd respondents stood trial and were convicted and sentenced.

DECISION/HELD

On the whole, the Court found merit in the appeal and accordingly allowed same. The aspect of the judgment of the Federal High Court indicting the appellant was set aside.

Bus preacher beaten to coma in Onitsha after condoms fell from Bible

A bus preacher was almost lynched at popular Upper Iweka Park in Onitsha, when some condoms allegedly fell out of his bible as he preached the ‘Word of God’.

Report gathered that the self acclaimed Man of God was dragged out of the commercial bus and beaten into a pulp before he was rescued by some policemen.

According to an eye witness, Mr Uche Chukwujekwu, a passenger at a popular commercial bus service provider going to Lagos and other parts of the country was on board the bus when the preacher came to minister and pray for the travelers and as well wish them safety on their way to their destinations.

“Though they were moved by self-acclaimed pastors preaching, anointing of God was everywhere; some passenger gave their lives to Christ and accepted Him as their Lord and personal saviour.

“It was amazing when opened his bible to collect offering from the passengers who may wish to assist him in his ministry, behold 3 Kiss condoms fell off his bible.

“The angry men in the bus who had been having bad feelings about pastors, who preach in buses along various parks in Onitsha as an undercover for begging got really angry and pounced on him, who all of a sudden started shouting and pleading for forgiveness because he does that as business not really for true word of God ”

However, Policemen had to be called to the scene to save the pastors life. So far 2 arrests have been made for further investigations.

100 women CSOs urge UN to strip Kogi governor of commendation letter

*** Allege serial violations of women’s rights in Kogi
A coalition of over 100 feminist Civil Society Organisations, has asked the United Nations to immediately withdraw its commendation of Kogi State governor, Mr. Yahaya Bello as “gender-friendly” for appointing an all female deputy Local Government Area chairpersons across the state.

In a letter dated 29 January, 2012, which was addressed the UN Resident Coordinator for Nigeria, Mr. Edward Kallon, the group under the aegis of Feminist Womanifest, said a retraction of Mr. Bello’s endorsement became necessary as it would help to acknowledge the pains of victims of sexual and gender-based violence in Kogi and Nigeria.

The protest letter which was signed by Dr. Abiola Akiyode-Afolabi, Co- Convener Feminist Womanifesto, on behalf of the 100 CSOs cataloged a legion of women politicians and personalities who had allegedly suffered at the hands of the Kogi State governor and his goons.

“The implication of this endorsement or commendation for a politician who is currently a governor are as follows: That the UN is celebrating a Governor who:i. has publicly stated that the COVID-19 Vaccine is meant to kill people; emerged as Governor in a controversial election which saw his political opponents such as Ms. Natasha Akpoti being threatened with violence and which saw another female member of an opposing political party, Mrs. Salome Abuh, burnt to death in her own house by thugs; has continued to implicitly support a Commissioner in his cabinet who has an ongoing case of sexual assault of a woman in Kogi State,” the group lamented.

It further berated the Kogi State government’s refusal to “domesticate the Violence Against Persons (Prohibition) Act 2015 thereby failing to provide legal protections for vulnerable women and children in Kogi State.

“We also call on the United Nations Office in Nigeria and UN Women to support some of the women groups working to provide gender-based violence support services for the women of Kogi State, especially those working on some of the cases highlighted above.

“It is important that the United Nations Office in Nigeria and UN Women is seen to have done its best to protect human rights and foster the empowerment of Nigerian women and to do this in a manner which protects the United Nations brand while remaining faithful to the UN Charter.

“We call on the United Nations Office in Nigeria and UN Women to urgently and publicly take steps to deal with this perception that the Governor has been endorsed by the United Nations,” the group advised.

The Feminist Womanifesto, a coalition of civil society organisations working for the realisation of women’s rights in Nigeria, expressed its “dismay at the UN Women’s letter to the Kogi State Governor dated 26 January 2021, commending the Governor of Kogi State for recently appointing women as deputy chairpersons in all the 21 Local Government Areas (LGAs) of Kogi State”.
